1. Scope
These General Terms and Conditions ("T&C") apply to all offers, orders and services of PrintMyWall.ch, a business unit of Atunetti GmbH ("PrintMyWall").
Deviating agreements are only binding if confirmed by PrintMyWall in writing or in text form.
By accepting a quote or placing an order, the customer confirms having taken note of these T&C and agrees to their application.
2. Offer and conclusion of contract
Unless otherwise stated in the offer, offers from PrintMyWall are valid for 30 days. A contract is concluded as soon as the customer accepts the quote in writing, electronically or in any other clearly verifiable form, or instructs PrintMyWall to carry out the work.
The scope, execution and price of the service are governed by the quote or order confirmation and these T&C.
Subsequent changes or additional requests by the customer may be invoiced separately.
3. Prices and payment terms
All prices are in Swiss francs (CHF). Whether and to what extent VAT is owed depends on the applicable tax status of Atunetti GmbH and is shown accordingly in the quote or invoice.
Additional services not included in the agreed quote – in particular additional graphic work, additional site visits, changes after approval, special preparatory work or additional travel – may be invoiced on a time-and-materials basis.
Unless otherwise agreed, invoices are payable within 10 days of the invoice date without deduction.
For larger orders, PrintMyWall may request a reasonable advance payment. This will be stated in the quote.
In the event of late payment, PrintMyWall is entitled to suspend further work until payment is received and to assert the statutory consequences of default.
4. Requirements at the place of work
The customer ensures that the agreed work area is freely accessible and prepared for the work on the agreed date.
Before the work is carried out, the customer informs PrintMyWall of any known particularities of the wall or substrate, in particular moisture, previous water damage, loose or sensitive coatings, special paints, wallpaper, types of plaster or other circumstances that could affect the execution or adhesion of the print.
PrintMyWall assesses the substrate with the care customary for such work. Properties of the substrate that are not recognisable or cannot be detected despite customary inspection lie outside PrintMyWall's responsibility.
If the substrate proves unsuitable, PrintMyWall may interrupt or postpone the work and recommend suitable preparation or remediation measures to the customer.
Necessary additional work is only carried out after consultation with the customer and may be invoiced additionally.
5. Designs, images and copyright
The customer is responsible for holding all necessary rights to the images, logos, graphics, photographs, trademarks, texts and other content they provide. By handing over or approving a design, the customer confirms that its use for the agreed purpose is permitted and does not infringe any third-party rights.
PrintMyWall is not obliged to check the legal admissibility of content supplied by the customer. To the extent permitted by law, the customer indemnifies PrintMyWall against third-party claims arising from an infringement of copyright, trademark, personality or other rights for which the customer is responsible. PrintMyWall may refuse to print content that is obviously unlawful, discriminatory, inhuman or otherwise unacceptable.
6. Visualisation and approval
On request, PrintMyWall can create a digital visualisation or simulation of the planned wall print before execution.
This visualisation is for illustrative purposes only and is not a binding representation of the colours, scale or details of the final wall print.
Before final execution, the customer receives the design or layout for approval, where agreed or necessary.
By approving, the customer confirms in particular the design, content, spelling, general positioning and layout.
Changes after approval may be invoiced additionally on a time-and-materials basis.
7. Colours and appearance
For technical reasons, the colour rendering of a wall print may differ from its appearance on screens, smartphones, paper prints or visualisations.
Wall colour, substrate, surface texture, lighting conditions and ambient light can also affect the visual result.
Minor deviations in colour, positioning, sharpness or appearance that are technically or materially unavoidable do not constitute a defect, provided that the overall impression and the agreed service are not significantly impaired.
8. Execution and scheduling
PrintMyWall carries out the work professionally and with the care customary in the industry.
Agreed dates are adhered to wherever possible.
Delays due to circumstances for which PrintMyWall is not responsible – in particular unsuitable wall conditions, technical faults despite proper maintenance, illness, force majeure, lack of access to the property or delays caused by the customer – entitle PrintMyWall to reasonably postpone the execution date.
In such cases, PrintMyWall informs the customer as soon as possible.
9. Acceptance and defects
The customer must inspect the wall print upon completion.
Recognisable defects should be reported to PrintMyWall as quickly as possible in writing or by email and, where possible, documented with photographs.
Where mandatory statutory notice periods for defects apply, these remain fully reserved. In the event of a justified defect, PrintMyWall is in principle entitled to remedy the defect within a reasonable period, insofar as this is possible and reasonable.
Further mandatory statutory rights of the customer remain reserved.
No warranty is given for defects or damage caused in particular by:
- unsuitable or subsequently altered substrates;
- moisture or damage to the building;
- damage caused by the customer or third parties;
- improper cleaning or treatment;
- subsequent structural alterations;
- faulty or insufficient-quality image or graphic data supplied by the customer;
- circumstances about which PrintMyWall expressly warned the customer before execution.
10. Liability
PrintMyWall is liable for damage caused by intentional or grossly negligent conduct on the part of PrintMyWall.
To the extent permitted by law, liability for slight negligence and for indirect and consequential damage – in particular loss of profit, loss of use or loss of production – is excluded. Mandatory statutory liability provisions remain reserved.
In particular, PrintMyWall is not liable for damage attributable to properties or defects of the substrate that could not have been recognised during a professional inspection before the work began.
11. Customer cooperation and additional expenses
If an agreed appointment cannot be carried out, or not in full, for reasons within the customer's sphere of responsibility, PrintMyWall may invoice the reasonable expenses incurred as a result.
These include in particular additional travel, waiting times or preparatory and graphic work already carried out.
The customer ensures in particular the agreed access to the property, a sufficiently clear work area and – where necessary – electricity and normal working conditions.
12. Cancellation by the customer
PrintMyWall must be notified of the cancellation of a confirmed order as early as possible. Up to 7 calendar days before the agreed execution date, the customer may in principle cancel the order free of charge; however, graphic, planning, site-visit or other preliminary work already carried out individually will be invoiced on a time-and-materials basis.
In the event of a later cancellation, PrintMyWall may additionally invoice the costs and expenses demonstrably incurred or no longer avoidable.
In the event of cancellation within 48 hours of the agreed execution date, PrintMyWall may, in addition to the costs and expenses already incurred or no longer avoidable, charge a flat-rate cancellation and inconvenience fee of 20% of the agreed order value, but at least CHF 150. The customer remains entitled to prove that no or significantly less additional damage was incurred.
Mandatory statutory rights of the customer remain reserved.
13. No voluntary right of withdrawal
Unless there is a mandatory statutory right of withdrawal or rescission, PrintMyWall does not grant any additional general right of withdrawal.
This applies in particular to wall prints planned, designed or executed individually for the customer. The cancellation options under section 12 remain reserved.
14. Reference images
PrintMyWall only uses photographs of completed work for its own reference and marketing purposes with the customer's consent.
If people, personal information, licence plates or other identifying features are visible in photographs, these will not be published without appropriate consent or will be made unrecognisable where necessary.
15. Data protection
PrintMyWall processes personal data exclusively within the framework of applicable data protection legislation and to the extent necessary for preparing offers, processing orders, customer support and fulfilling legal obligations.
Further information can be found in the separate privacy policy on PrintMyWall.ch.
16. Applicable law and place of jurisdiction
Swiss law applies exclusively.
For disputes arising from contracts with business customers, the place of jurisdiction is – to the extent permitted by law – the registered office of Atunetti GmbH.
For contracts with consumers, the mandatory statutory provisions on jurisdiction apply.
17. Final provisions
Should individual provisions of these T&C be invalid or unenforceable, the remaining provisions shall remain unaffected.
PrintMyWall may amend these T&C for future contracts. Each order is governed by the version made available to the customer at the time the contract was concluded and incorporated into the contract.
