1. Scope of Application

These General Terms and Conditions (“GTC”) apply to all offers, orders and services provided by PrintMyWall.ch, a business division of Atunetti GmbH (“PrintMyWall”).

Any deviating agreements shall only be binding if they have been confirmed by PrintMyWall in writing or in text form.

By accepting an offer or placing an order, the customer confirms that they have read and understood these GTC and agree to their application.

2. Offer and Conclusion of Contract

Unless otherwise stated in the offer, offers from PrintMyWall are valid for 30 days.

A contract is concluded as soon as the customer accepts the offer in writing, electronically or in another clearly verifiable form, or commissions PrintMyWall to carry out the work.

The scope, execution and price of the services are determined by the offer or order confirmation and these GTC.

Subsequent requests for changes or additional services by the customer may be charged separately.

3. Prices and Payment Terms

All prices are stated in Swiss francs (CHF). Whether and to what extent value added tax (VAT) is payable depends on the applicable tax status of Atunetti GmbH and will be stated accordingly in the offer or invoice.

Additional services that are not included in the agreed offer, in particular additional graphic work, additional site visits, changes made after approval, special preparatory work or additional travel, may be charged based on the time and effort involved.

Unless otherwise agreed, invoices are payable within 10 days of the invoice date without deduction.

For larger orders, PrintMyWall may require a reasonable advance payment. This will be stated in the offer.

In the event of late payment, PrintMyWall is entitled to suspend further work until payment has been received and to assert the statutory consequences of late payment.

4. Conditions at the Place of Execution

The customer shall ensure that the agreed work area is freely accessible and prepared for the work at the agreed date and time.

Before the work is carried out, the customer shall inform PrintMyWall of any known special characteristics of the wall or substrate, in particular moisture, previous water damage, loose or sensitive coatings, special paints, wallpapers, types of plaster or any other circumstances that could affect the execution or adhesion of the print.

PrintMyWall shall assess the substrate with the level of care customary for such work. Characteristics of the substrate that are not apparent or cannot be detected despite a customary inspection are outside PrintMyWall’s area of responsibility.

If the substrate proves to be unsuitable, PrintMyWall may interrupt or postpone the work and recommend appropriate preparation or remediation measures to the customer.

Necessary additional work shall only be carried out after consultation with the customer and may be charged separately.

5. Motifs, Image Material and Copyright

The customer is responsible for ensuring that they possess all necessary rights to the images, logos, graphics, photographs, trademarks, texts and other content provided by them.

By submitting or approving a motif, the customer confirms that its use for the agreed purpose is permitted and does not infringe any third-party rights.

PrintMyWall is not obliged to verify the legal admissibility of content supplied by the customer.

To the extent permitted by law, the customer shall indemnify and hold PrintMyWall harmless against third-party claims arising from any infringement of copyright, trademark rights, personality rights or other rights for which the customer is responsible.

PrintMyWall may refuse to execute content that is manifestly unlawful, discriminatory, degrading to human dignity or otherwise unreasonable or unacceptable.

6. Visualisation and Approval

Upon request, PrintMyWall may create a digital visualisation or simulation of the planned wall print prior to execution.

This visualisation is intended for illustrative purposes only and does not constitute a binding representation of the colours, dimensions or details of the final wall print.

Before final execution, the customer shall receive the motif or design for approval, where agreed or required.

By granting approval, the customer confirms in particular the motif, content, spelling, general positioning and design.

Changes requested after approval may be charged additionally based on the time and effort involved.

7. Colours and Appearance

The colour reproduction of a wall print may differ for technical reasons from its representation on screens, smartphones, paper printouts or visualisations.

The wall colour, substrate, surface texture, lighting conditions and ambient light may also affect the visual appearance.

Minor deviations in colour, positioning, sharpness or appearance that are technically or materially unavoidable do not constitute a defect, provided that the overall impression and the agreed service are not materially affected.

8. Execution and Deadlines

PrintMyWall shall carry out the work professionally and with the level of care customary in the industry.

Agreed deadlines shall be observed wherever possible.

Delays caused by circumstances for which PrintMyWall is not responsible — in particular unsuitable wall conditions, technical disruptions despite proper maintenance, illness, force majeure, lack of access to the property or delays caused by the customer — entitle PrintMyWall to reasonably postpone the execution date.

In such cases, PrintMyWall shall inform the customer as soon as reasonably possible.

9. Acceptance and Defects

The customer shall inspect the completed wall print after completion.

Any visible defects should be reported to PrintMyWall as soon as possible in writing or by email and, where possible, documented photographically.

For work subject to mandatory statutory periods for the notification of defects, such statutory periods remain fully reserved.

In the event of a justified defect, PrintMyWall shall generally have the right to remedy the defect within a reasonable period, insofar as this is possible and reasonable.

Any further mandatory statutory rights of the customer remain reserved.

No warranty shall apply to defects or damage caused in particular by:

unsuitable substrates or substrates subsequently modified;
moisture or structural damage;
damage caused by the customer or third parties;
improper cleaning or treatment;
subsequent structural alterations;
incorrect or insufficient-quality image or graphic data supplied by the customer;
circumstances about which PrintMyWall expressly warned the customer prior to execution.
10. Liability
PrintMyWall shall be liable for damage caused by intentional or grossly negligent conduct on the part of PrintMyWall.

To the extent permitted by law, liability for ordinary negligence as well as for indirect and consequential damages, in particular loss of profit, loss of use or production downtime, is excluded.

Mandatory statutory liability provisions remain unaffected.

In particular, PrintMyWall shall not be liable for damage attributable to characteristics or defects of the substrate that could not have been detected during a professional inspection prior to the commencement of the work.

11. Customer’s Cooperation and Additional Costs

If an agreed appointment cannot be carried out, or cannot be carried out in full, for reasons within the customer’s area of responsibility, PrintMyWall may charge the reasonable costs incurred as a result.

These include, in particular, additional travel, waiting time or preparatory and graphic work already carried out.

The customer shall in particular ensure agreed access to the property, a sufficiently clear work area and, where required, electricity and normal working conditions.

12. Cancellation by the Customer

Cancellation of a confirmed order must be communicated to PrintMyWall as early as possible.

Up to 7 calendar days before the agreed execution date, the customer may generally cancel the order free of charge. However, any individually performed graphic, planning, site inspection or other preparatory services shall be charged based on the time and effort involved.

In the event of a later cancellation, PrintMyWall may additionally invoice costs and expenses that have demonstrably been incurred or can no longer be avoided.

If the order is cancelled within 48 hours of the agreed execution date, PrintMyWall may, in addition to costs and expenses already incurred or no longer avoidable, charge a flat-rate cancellation and administrative fee of 20% of the agreed order value, subject to a minimum of CHF 150.

The customer remains entitled to demonstrate that no additional damage, or substantially lower additional damage, has occurred.

Mandatory statutory rights of the customer remain reserved.

13. No Voluntary Right of Withdrawal

Unless a mandatory statutory right of withdrawal or cancellation applies, PrintMyWall does not grant any additional general right of withdrawal.

This applies in particular to wall prints individually planned, designed or produced for the customer.

The cancellation options pursuant to Section 12 remain unaffected.

14. Reference Photographs

PrintMyWall shall only use photographs of completed work for its own reference and marketing purposes with the customer’s consent.

If persons, personal information, vehicle registration plates or other identifying features are visible in photographs, they shall not be published without the appropriate consent or shall be anonymised where necessary.

15. Data Protection

PrintMyWall processes personal data exclusively within the framework of applicable data protection legislation and insofar as this is necessary for preparing offers, processing orders, customer support and fulfilling statutory obligations.

16. Applicable Law and Place of Jurisdiction

Swiss law shall apply exclusively.

For disputes arising from contracts with business customers, the registered office of Atunetti GmbH shall, to the extent permitted by law, constitute the place of jurisdiction.

For contracts with consumers, the mandatory statutory provisions regarding the place of jurisdiction shall apply.

17. Final Provisions

Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

PrintMyWall may amend these GTC for future contracts. For each order, the version made available to the customer at the time of conclusion of the contract and incorporated into the contract shall apply.
